To use it, S!MPATI® must be installed; the module itself is a free component within a Simpati maintenance contract.
  • S!MPATI® time labs 4.70: S!MPATI® time labs enables the simultaneous recording of measurement data and images from cameras and the displaying with the evaluation software included in S!MPATI®. To use it, S!MPATI® must be installed and an extra license must be purchased.
  • Simpati Service 4.70: By installing the "Simpati Service" service module, all S!MPATI® system processes in Windows are executed as a background service and automatically started after a restart of the operating system. This allows Simpati to run even if the Windows user is logged off. For use S!MPATI® must be installed, the module itself is free of charge.

Installation/ Uninstallation Simpati 4.70.1

The installation routine has been further optimised with release 4.70.1.

  • The installation package can be used both as an update for version 4.70 and for a new installation.
  • When installing as an update, Simpati does not have to be registered again.
  • When uninstalling, the Simpati registration file is not removed
  • In the case of a new installation, the file Simpati.str automatically contains entries for Klima2000 units

User administration
The user administration has been extended to allow a connection to the Weiss OPC/UA solution.

Status menu
It is now possible to set limit values for data loggers via the status user interface.

List of bugs fixed/corrected with this version

  • If time corrections are made to the past (e.g. by an NTP server), the current archiving process stops)
  • Under certain conditions the main menu is only opened minimally in the Windows task bar
  • In case of a longer interruption of the data transmission, the SimViewer will not display the missing data as gaps in the recording
  • Measuring tape correction only works after switching the view
  • When zooming, SimViewer displays incorrect values in the measuring tape
  • During time changes, the recorded data is not displayed correctly in the order of occurrence
  • Data recording deviation after 4 days > 1 second
  • Values of profiles with ID 1000 are not displayed correctly
  • SimServ crashes due to missing performance counter
  • Wrong spelling in Simserv command line help
  • Chamber names cannot be read from the controller
  • For very long profile names, the conversion of text programs into the symbolic format fails

Known Issues and Limitations

  • Day/night programs created in WebSeason are not supported by Simpati and therefore cannot be transferred from the device to Simpati.
  • Title of the main menu is not unicode compatible: For example, Chinese characters become question marks ("?")
  • Missing umlauts in pdf/a export: When exporting from the report the umlauts "disappear" from the text. This can lead to misunderstandings (e.g. with umlauts in names or similar).
  • Program transfer: In the message window for the confirmation of the programme transfer the programme name is missing
  • Missing report entry when manually locking/unlocking an installation:
  • Archiving: A change of the archiving interval via the SimArchiveDialog is overwritten when restarting Simpati.
    Remedy: Change the archiving interval via the chamber configuration.
  • SimViewer display of the month: SimViewer currently displays months always with 30 days.
  • SimViewer: CSV-Export: All available profiles are exported, despite other selection
  • SimViewer: When switching to the past while recording is running, the data is not updated as long as the time entries are in the past
  • SimViewer: Picture display - if the time to be displayed is not selected with the slider but with arrow keys or keyboard, the picture is not updated
  • When opening the evaluation via the main menu, the user rights are not checked
  • Warning limits deactivated in the PLC cannot be activated via Simpati
  • Missing simpati.sys- file leads to a Simconfig error when starting Simpati Remedy: Start SimConfig.exe from the Windows start directory
  • The "Delete User" button can also be selected for the system user "Admin", but the user is correctly not deleted.
  • If the symbolic editor is open when closing Simpati, it will not be closed automatically.

License terms

1. Scope of application
The companies named above (hereinafter referred to as “WEISS”) supply computer programs in electronic form such as Simpati and PLC control and visualisation programs (hereinafter Software) to customers (licensees).

The terms and conditions indicated in the following apply exclusively to the granting of usage rights to Software by WEISS. Other general business terms and conditions of the customer shall not apply, unless expressly approved by WEISS (in writing as a minimum requirement).

2. Deliveries and services of WEISS
The scope of delivery is specified in detail by the current product description including additional information in the application documentation. WEISS supplies the Software in the version that is valid at the time of supply or provision. The scope of delivery does not include installation, instruction or training services. The Software is supplied on a data storage device or can be downloaded from a WEISS website at WEISS’ discretion. The customer receives rights to the object code of the Software exclusively. It shall not have the right to use or transfer the source code.

Services relating to the support and maintenance of the Software shall be provided by WEISS exclusively on the basis of a separate written agreement.

3. Granting of usage rights
WEISS grants the customer - subject to a divergent individual, written contractual agreement - and subject to the condition precedent of complete and timely payment of the agreed remuneration, the non-exclusive, permanent, irrevocable and irredeemable right to use the software, i.e. in particular to store or load it permanently or temporarily, display or execute it.

Unless expressly agreed otherwise, the usage rights shall be granted exclusively for the country in which the customer has its headquarters. If the customer's headquarters are within the European Union, usage rights shall apply across the EU. The customer may use the software only for the contractually stipulated purpose. Commercial sub-leasing is prohibited. Duplication of the software is permitted only to the extent necessary for use as contractually agreed. The customer may produce backup copies of the software in accordance with its codes of practice to the extent necessary. Backup copies on mobile data storage devices must be identified as such with the copyright notice of the original data storage device applied.

Should the customer transfer its usage rights to a third party, it must impose on this party its duties and obligations from these terms and conditions with respect to the content and scope of the usage rights. Transferring to a third party shall remove the customer’s entitlement to use the Software. It must delete any copies it holds of the Software, provided such are not copies produced for backing up in accordance with the terms and conditions.

The customer undertakes not to convert the software to an alternative code form or to make any changes, extensions or otherwise edit the software, except as permissible in accordance with statutory provisions.

Where WEISS provides to the customer extensions to (e.g. patches, extensions to user manual) or new editions of the software (e.g. updates, upgrades) replacing software provided previously (“outdated software”), such are subject to these terms and conditions. Where WEISS provides a new edition of the software, the entitlement of the customer to use the outdated software shall cease, including without the explicit request by WEISS to return the software, once it begins using the new edition in a productive capacity. WEISS, however, shall grant the customer a three-month transition phase in which it may continue using both versions side-by-side. Duplication or alteration of the application documentation is not permissible, subject to the above provisions.

In the case of software products of third party manufacturers sold by WEISS or third party software components implemented by WEISS, the terms and conditions of use of the respective third party manufacturer shall apply to these software packages/components in the first instance.

4. Duty of cooperation of the customer
The customer shall take reasonable precautions to safeguard against software supplied by WEISS failing to operate properly, either partially or entirely. It shall be required to test the Software thoroughly to ensure the absence of defects, its usability for the purpose it intends and in the hardware and software environment provided by it, before putting into operational use. This also applies to software that it receives from WEISS in connection with the provision of maintenance or based on warranty. The customer shall be solely responsible for ensuring the presence or establishment of a serviceable, adequately dimensioned hardware and software environment.

Furthermore, it shall ensure that its data is backed up using the latest systems. It shall ensure that any up-to-date data stored in machine-readable format is reproducible with reasonable effort. The customer shall maintain an IT security concept using the latest available systems, to consist of technical and organisational measures. This shall include in particular appropriate measures to prevent unauthorised third party access to the Software.

The customer must immediately report to WEISS any defects detected. Notifications of defects must include information on the nature of the fault, in the case of software the module in which the fault occurred, and the operations undertaken when the fault occurred. A prerequisite for supplementary performance in accordance with Section 5 is the reproducibility or detectability of the reported defect.

5. Material defects and defects of title
WEISS provides the customer with deliveries and services free of material defects and defects of title. The customer is aware that minor software bugs that do not restrict the usability of the software or which limit its use only to a negligible degree cannot be fully eliminated in software products. Bugs of this nature do not constitute software defects in terms of the warranty. In the case of software, moreover, functional impairments resulting from the hardware and software environment provided by the customer, incorrect operation, defective external data, malfunctions of computer networks or other causes originating from the area of risk of the customer are not considered defects.

WEISS shall not be responsible for software modified unlawfully by the customer, unless the customer can prove that the modification is not the cause of the reported fault. If products or services provided by WEISS are faulty and a corresponding complaint has been made in writing and in good time by the customer, WEISS shall provide replacements or rectify any issues at its discretion. WEISS is to be given the chance to do so within a reasonable time frame of at least 14 working days. In the case of software, rectification in particular may take the course of providing a new program version, or WEISS indicating reasonable methods to circumvent the effects of the fault. The customer must accept the provision of a new program version including if associated with acceptable outlay for adaptation.

Rectification in the case of defects of title occurs by WEISS providing the customer with the means to use the software legally. WEISS in this regard may replace the software product for one of equal value and which complies with contractual provisions, if acceptable to the customer. Should third parties claim against the customer on the basis of property rights, the customer must notify WEISS of this in writing immediately. WEISS shall at its discretion and in consultation with the customer defend against or settle such claims. The customer must not acknowledge third party claims or settle these amicably. WEISS shall defend against third party claims at its own expense and shall indemnify the customer against all necessary costs and losses associated with defending against such action, provided such is not due to conduct on the part of the customer in breach of the terms and conditions. If attempts at rectification fail, the customer shall be allowed to reduce the fee payable or withdraw from the contract. Withdrawal, however, is permissible only if the customer previously and explicitly threatens WEISS with this in writing with a suitable further deadline.

6. Compensation for damages
Unless otherwise stated in the following regulations, WEISS shall be liable in accordance with statutory provisions in the case of the breach of contractual and non-contractual obligations. WEISS shall be liable for compensation for damages - irrespective of the legal basis - in the context of fault liability in cases of intent and gross negligence. In the case of simple negligence, WEISS shall be liable in accordance with statutory provisions subject to a more moderate standard of liability (e.g. for diligence in own affairs) only

a) for losses resulting from loss of life, physical injury or damage to health,

b) for losses resulting from a significant breach of a material contractual obligation (an obligation the fulfilment of which is essential to the proper execution of the contract and which the contractual partner regularly expects and should expect to be complied with); in such cases, however, liability shall be limited to the compensation of predictable, typically occurring losses.

The liability limitations indicated above shall also apply to breaches of duty by or benefiting persons whose culpability WEISS is responsible for in accordance with statutory provisions. The limitations shall not apply if WEISS fraudulently conceals a defect or has assumed a quality guarantee, or to claims of the customer under the Product Liability Act [Produkthaftungsgesetz]. Statements on the properties of the Software are to be viewed as descriptive of performance and do not constitute a quality or durability guarantee as defined by Art. 443 of the German Civil Code [BGB - Bürgerliches Gesetzbuch].

In the case of data loss, WEISS shall be liable only for losses that would still have occurred had the customer properly backed up data (Section 4).

7. Liability of customer and extraordinary termination
The customer shall be liable to WEISS for all losses incurred by WEISS from the violation of copyright provisions in Section 3.

WEISS shall be entitled to revoke the usage rights granted to the customer if the customer repeatedly exceeds the usage rights granted under Section 3 despite a warning from WEISS or fails to take suitable IT security precautions using the latest systems as defined by Section 4. In this case, the customer shall be obligated to immediately cease use of the original software along with any copies and to destroy these. The customer must send a written confirmation of destruction to the address specified below.

8. Place of jurisdiction and choice of law
The law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) applies to all legal relationships between WEISS and the customer based on these terms and conditions.

The parties are aware that the software may be subject to export and import restrictions. In particular, authorisation requirements may exist or usage of the software or associated technologies may be subject to restrictions outside of Germany. The customer is required to adhere to applicable export and import control provisions of the Federal Republic of Germany, the European Union and the USA, and all other relevant regulations. Fulfilment of the contract by the Licensor is subject to the proviso that fulfilment is not impeded by national and international regulations of export and import law or by any other legal provisions.

If the customer is a merchant, public-law special fund or a legal entity under public law, the exclusive place of jurisdiction for all claims resulting from the aforementioned legal relationships shall be the registered office of WEISS; where legal action is taken by WEISS, the general place of jurisdiction of the customer shall also apply.

License terms

1. Scope of application
The companies named above (hereinafter referred to as “WEISS”) supply computer programs in electronic form such as Simpati and PLC control and visualisation programs (hereinafter Software) to customers (licensees).

The terms and conditions indicated in the following apply exclusively to the granting of usage rights to Software by WEISS. Other general business terms and conditions of the customer shall not apply, unless expressly approved by WEISS (in writing as a minimum requirement).

2. Deliveries and services of WEISS
The scope of delivery is specified in detail by the current product description including additional information in the application documentation. WEISS supplies the Software in the version that is valid at the time of supply or provision. The scope of delivery does not include installation, instruction or training services. The Software is supplied on a data storage device or can be downloaded from a WEISS website at WEISS’ discretion. The customer receives rights to the object code of the Software exclusively. It shall not have the right to use or transfer the source code.

Services relating to the support and maintenance of the Software shall be provided by WEISS exclusively on the basis of a separate written agreement.

3. Granting of usage rights
WEISS grants the customer - subject to a divergent individual, written contractual agreement - and subject to the condition precedent of complete and timely payment of the agreed remuneration, the non-exclusive, permanent, irrevocable and irredeemable right to use the software, i.e. in particular to store or load it permanently or temporarily, display or execute it.

Unless expressly agreed otherwise, the usage rights shall be granted exclusively for the country in which the customer has its headquarters. If the customer's headquarters are within the European Union, usage rights shall apply across the EU. The customer may use the software only for the contractually stipulated purpose. Commercial sub-leasing is prohibited. Duplication of the software is permitted only to the extent necessary for use as contractually agreed. The customer may produce backup copies of the software in accordance with its codes of practice to the extent necessary. Backup copies on mobile data storage devices must be identified as such with the copyright notice of the original data storage device applied.

Should the customer transfer its usage rights to a third party, it must impose on this party its duties and obligations from these terms and conditions with respect to the content and scope of the usage rights. Transferring to a third party shall remove the customer’s entitlement to use the Software. It must delete any copies it holds of the Software, provided such are not copies produced for backing up in accordance with the terms and conditions.

The customer undertakes not to convert the software to an alternative code form or to make any changes, extensions or otherwise edit the software, except as permissible in accordance with statutory provisions.

Where WEISS provides to the customer extensions to (e.g. patches, extensions to user manual) or new editions of the software (e.g. updates, upgrades) replacing software provided previously (“outdated software”), such are subject to these terms and conditions. Where WEISS provides a new edition of the software, the entitlement of the customer to use the outdated software shall cease, including without the explicit request by WEISS to return the software, once it begins using the new edition in a productive capacity. WEISS, however, shall grant the customer a three-month transition phase in which it may continue using both versions side-by-side. Duplication or alteration of the application documentation is not permissible, subject to the above provisions.

In the case of software products of third party manufacturers sold by WEISS or third party software components implemented by WEISS, the terms and conditions of use of the respective third party manufacturer shall apply to these software packages/components in the first instance.

4. Duty of cooperation of the customer
The customer shall take reasonable precautions to safeguard against software supplied by WEISS failing to operate properly, either partially or entirely. It shall be required to test the Software thoroughly to ensure the absence of defects, its usability for the purpose it intends and in the hardware and software environment provided by it, before putting into operational use. This also applies to software that it receives from WEISS in connection with the provision of maintenance or based on warranty. The customer shall be solely responsible for ensuring the presence or establishment of a serviceable, adequately dimensioned hardware and software environment.

Furthermore, it shall ensure that its data is backed up using the latest systems. It shall ensure that any up-to-date data stored in machine-readable format is reproducible with reasonable effort. The customer shall maintain an IT security concept using the latest available systems, to consist of technical and organisational measures. This shall include in particular appropriate measures to prevent unauthorised third party access to the Software.

The customer must immediately report to WEISS any defects detected. Notifications of defects must include information on the nature of the fault, in the case of software the module in which the fault occurred, and the operations undertaken when the fault occurred. A prerequisite for supplementary performance in accordance with Section 5 is the reproducibility or detectability of the reported defect.

5. Material defects and defects of title
WEISS provides the customer with deliveries and services free of material defects and defects of title. The customer is aware that minor software bugs that do not restrict the usability of the software or which limit its use only to a negligible degree cannot be fully eliminated in software products. Bugs of this nature do not constitute software defects in terms of the warranty. In the case of software, moreover, functional impairments resulting from the hardware and software environment provided by the customer, incorrect operation, defective external data, malfunctions of computer networks or other causes originating from the area of risk of the customer are not considered defects.

WEISS shall not be responsible for software modified unlawfully by the customer, unless the customer can prove that the modification is not the cause of the reported fault. If products or services provided by WEISS are faulty and a corresponding complaint has been made in writing and in good time by the customer, WEISS shall provide replacements or rectify any issues at its discretion. WEISS is to be given the chance to do so within a reasonable time frame of at least 14 working days. In the case of software, rectification in particular may take the course of providing a new program version, or WEISS indicating reasonable methods to circumvent the effects of the fault. The customer must accept the provision of a new program version including if associated with acceptable outlay for adaptation.

Rectification in the case of defects of title occurs by WEISS providing the customer with the means to use the software legally. WEISS in this regard may replace the software product for one of equal value and which complies with contractual provisions, if acceptable to the customer. Should third parties claim against the customer on the basis of property rights, the customer must notify WEISS of this in writing immediately. WEISS shall at its discretion and in consultation with the customer defend against or settle such claims. The customer must not acknowledge third party claims or settle these amicably. WEISS shall defend against third party claims at its own expense and shall indemnify the customer against all necessary costs and losses associated with defending against such action, provided such is not due to conduct on the part of the customer in breach of the terms and conditions. If attempts at rectification fail, the customer shall be allowed to reduce the fee payable or withdraw from the contract. Withdrawal, however, is permissible only if the customer previously and explicitly threatens WEISS with this in writing with a suitable further deadline.

6. Compensation for damages
Unless otherwise stated in the following regulations, WEISS shall be liable in accordance with statutory provisions in the case of the breach of contractual and non-contractual obligations. WEISS shall be liable for compensation for damages - irrespective of the legal basis - in the context of fault liability in cases of intent and gross negligence. In the case of simple negligence, WEISS shall be liable in accordance with statutory provisions subject to a more moderate standard of liability (e.g. for diligence in own affairs) only

a) for losses resulting from loss of life, physical injury or damage to health,

b) for losses resulting from a significant breach of a material contractual obligation (an obligation the fulfilment of which is essential to the proper execution of the contract and which the contractual partner regularly expects and should expect to be complied with); in such cases, however, liability shall be limited to the compensation of predictable, typically occurring losses.

The liability limitations indicated above shall also apply to breaches of duty by or benefiting persons whose culpability WEISS is responsible for in accordance with statutory provisions. The limitations shall not apply if WEISS fraudulently conceals a defect or has assumed a quality guarantee, or to claims of the customer under the Product Liability Act [Produkthaftungsgesetz]. Statements on the properties of the Software are to be viewed as descriptive of performance and do not constitute a quality or durability guarantee as defined by Art. 443 of the German Civil Code [BGB - Bürgerliches Gesetzbuch].

In the case of data loss, WEISS shall be liable only for losses that would still have occurred had the customer properly backed up data (Section 4).

7. Liability of customer and extraordinary termination
The customer shall be liable to WEISS for all losses incurred by WEISS from the violation of copyright provisions in Section 3.

WEISS shall be entitled to revoke the usage rights granted to the customer if the customer repeatedly exceeds the usage rights granted under Section 3 despite a warning from WEISS or fails to take suitable IT security precautions using the latest systems as defined by Section 4. In this case, the customer shall be obligated to immediately cease use of the original software along with any copies and to destroy these. The customer must send a written confirmation of destruction to the address specified below.

8. Place of jurisdiction and choice of law
The law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) applies to all legal relationships between WEISS and the customer based on these terms and conditions.

The parties are aware that the software may be subject to export and import restrictions. In particular, authorisation requirements may exist or usage of the software or associated technologies may be subject to restrictions outside of Germany. The customer is required to adhere to applicable export and import control provisions of the Federal Republic of Germany, the European Union and the USA, and all other relevant regulations. Fulfilment of the contract by the Licensor is subject to the proviso that fulfilment is not impeded by national and international regulations of export and import law or by any other legal provisions.

If the customer is a merchant, public-law special fund or a legal entity under public law, the exclusive place of jurisdiction for all claims resulting from the aforementioned legal relationships shall be the registered office of WEISS; where legal action is taken by WEISS, the general place of jurisdiction of the customer shall also apply.

By installing the "Simpati Service" service module, all S!MPATI® system processes in Windows are executed as a background service and automatically started after a restart of the operating system. This allows Simpati to run even if the Windows user is logged off. For use S!MPATI® must be installed, the module itself is free of charge.

  • The user is guided better through the installation process by more information and hints.
  • For the Simpati installation as a service a technical user is used whose password does not expire. This prevents that the service installation does not work correctly after the password expires.
  • For the Simpati service installation a separate installation package is now available. As a prerequisite the Simpati standard package must be installed before.
  • The uninstall routine has been optimized to remove registry, start menu and desktop entries that are no longer needed.

  • Misleading message when trying to install Simpati as a service without a previous base installation
  • When uninstalling Simpati Service, the generated registry keys are not removed

Known Issues and Limitations

  • Missing message for incomplete mailer configuration when installing Simpati as a service
    Remedy: Only start (activate) the mailer when all the necessary entries have been made on the settings page. (Verification by sending a test message)

    Remedy: Confirm the message with "OK"
  • When closing the main menu during a service installation, not all user interfaces of Simpati are automatically closed.
    Remedy: Do not only minimize user interfaces when leaving but close them.

In the case of simple negligence, WEISS shall be liable in accordance with statutory provisions subject to a more moderate standard of liability (e.g. for diligence in own affairs) only

a) for losses resulting from loss of life, physical injury or damage to health,

b) for losses resulting from a significant breach of a material contractual obligation (an obligation the fulfilment of which is essential to the proper execution of the contract and which the contractual partner regularly expects and should expect to be complied with); in such cases, however, liability shall be limited to the compensation of predictable, typically occurring losses.

The liability limitations indicated above shall also apply to breaches of duty by or benefiting persons whose culpability WEISS is responsible for in accordance with statutory provisions. The limitations shall not apply if WEISS fraudulently conceals a defect or has assumed a quality guarantee, or to claims of the customer under the Product Liability Act [Produkthaftungsgesetz]. Statements on the properties of the Software are to be viewed as descriptive of performance and do not constitute a quality or durability guarantee as defined by Art. 443 of the German Civil Code [BGB - Bürgerliches Gesetzbuch].

In the case of data loss, WEISS shall be liable only for losses that would still have occurred had the customer properly backed up data (Section 4).

7. Liability of customer and extraordinary termination
The customer shall be liable to WEISS for all losses incurred by WEISS from the violation of copyright provisions in Section 3.

WEISS shall be entitled to revoke the usage rights granted to the customer if the customer repeatedly exceeds the usage rights granted under Section 3 despite a warning from WEISS or fails to take suitable IT security precautions using the latest systems as defined by Section 4. In this case, the customer shall be obligated to immediately cease use of the original software along with any copies and to destroy these. The customer must send a written confirmation of destruction to the address specified below.

8. Place of jurisdiction and choice of law
The law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods (CISG) applies to all legal relationships between WEISS and the customer based on these terms and conditions.

The parties are aware that the software may be subject to export and import restrictions. In particular, authorisation requirements may exist or usage of the software or associated technologies may be subject to restrictions outside of Germany. The customer is required to adhere to applicable export and import control provisions of the Federal Republic of Germany, the European Union and the USA, and all other relevant regulations. Fulfilment of the contract by the Licensor is subject to the proviso that fulfilment is not impeded by national and international regulations of export and import law or by any other legal provisions.

If the customer is a merchant, public-law special fund or a legal entity under public law, the exclusive place of jurisdiction for all claims resulting from the aforementioned legal relationships shall be the registered office of WEISS; where legal action is taken by WEISS, the general place of jurisdiction of the customer shall also apply.

License terms

1. Scope of application
The companies named above (hereinafter referred to as “WEISS”) supply computer programs in electronic form such as Simpati and PLC control and visualisation programs (hereinafter Software) to customers (licensees).

The terms and conditions indicated in the following apply exclusively to the granting of usage rights to Software by WEISS. Other general business terms and conditions of the customer shall not apply, unless expressly approved by WEISS (in writing as a minimum requirement).

2. Deliveries and services of WEISS
The scope of delivery is specified in detail by the current product description including additional information in the application documentation. WEISS supplies the Software in the version that is valid at the time of supply or provision. The scope of delivery does not include installation, instruction or training services. The Software is supplied on a data storage device or can be downloaded from a WEISS website at WEISS’ discretion. The customer receives rights to the object code of the Software exclusively. It shall not have the right to use or transfer the source code.

Services relating to the support and maintenance of the Software shall be provided by WEISS exclusively on the basis of a separate written agreement.

3. Granting of usage rights
WEISS grants the customer - subject to a divergent individual, written contractual agreement - and subject to the condition precedent of complete and timely payment of the agreed remuneration, the non-exclusive, permanent, irrevocable and irredeemable right to use the software, i.e. in particular to store or load it permanently or temporarily, display or execute it.

Unless expressly agreed otherwise, the usage rights shall be granted exclusively for the country in which the customer has its headquarters. If the customer's headquarters are within the European Union, usage rights shall apply across the EU. The customer may use the software only for the contractually stipulated purpose. Commercial sub-leasing is prohibited. Duplication of the software is permitted only to the extent necessary for use as contractually agreed. The customer may produce backup copies of the software in accordance with its codes of practice to the extent necessary. Backup copies on mobile data storage devices must be identified as such with the copyright notice of the original data storage device applied.

Should the customer transfer its usage rights to a third party, it must impose on this party its duties and obligations from these terms and conditions with respect to the content and scope of the usage rights. Transferring to a third party shall remove the customer’s entitlement to use the Software. It must delete any copies it holds of the Software, provided such are not copies produced for backing up in accordance with the terms and conditions.

The customer undertakes not to convert the software to an alternative code form or to make any changes, extensions or otherwise edit the software, except as permissible in accordance with statutory provisions.

Where WEISS provides to the customer extensions to (e.g. patches, extensions to user manual) or new editions of the software (e.g. updates, upgrades) replacing software provided previously (“outdated software”), such are subject to these terms and conditions. Where WEISS provides a new edition of the software, the entitlement of the customer to use the outdated software shall cease, including without the explicit request by WEISS to return the software, once it begins using the new edition in a productive capacity. WEISS, however, shall grant the customer a three-month transition phase in which it may continue using both versions side-by-side. Duplication or alteration of the application documentation is not permissible, subject to the above provisions.

In the case of software products of third party manufacturers sold by WEISS or third party software components implemented by WEISS, the terms and conditions of use of the respective third party manufacturer shall apply to these software packages/components in the first instance.

4. Duty of cooperation of the customer
The customer shall take reasonable precautions to safeguard against software supplied by WEISS failing to operate properly, either partially or entirely. It shall be required to test the Software thoroughly to ensure the absence of defects, its usability for the purpose it intends and in the hardware and software environment provided by it, before putting into operational use. This also applies to software that it receives from WEISS in connection with the provision of maintenance or based on warranty. The customer shall be solely responsible for ensuring the presence or establishment of a serviceable, adequately dimensioned hardware and software environment.

Furthermore, it shall ensure that its data is backed up using the latest systems. It shall ensure that any up-to-date data stored in machine-readable format is reproducible with reasonable effort. The customer shall maintain an IT security concept using the latest available systems, to consist of technical and organisational measures. This shall include in particular appropriate measures to prevent unauthorised third party access to the Software.

The customer must immediately report to WEISS any defects detected. Notifications of defects must include information on the nature of the fault, in the case of software the module in which the fault occurred, and the operations undertaken when the fault occurred. A prerequisite for supplementary performance in accordance with Section 5 is the reproducibility or detectability of the reported defect.

5. Material defects and defects of title
WEISS provides the customer with deliveries and services free of material defects and defects of title. The customer is aware that minor software bugs that do not restrict the usability of the software or which limit its use only to a negligible degree cannot be fully eliminated in software products. Bugs of this nature do not constitute software defects in terms of the warranty. In the case of software, moreover, functional impairments resulting from the hardware and software environment provided by the customer, incorrect operation, defective external data, malfunctions of computer networks or other causes originating from the area of risk of the customer are not considered defects.

WEISS shall not be responsible for software modified unlawfully by the customer, unless the customer can prove that the modification is not the cause of the reported fault. If products or services provided by WEISS are faulty and a corresponding complaint has been made in writing and in good time by the customer, WEISS shall provide replacements or rectify any issues at its discretion. WEISS is to be given the chance to do so within a reasonable time frame of at least 14 working days. In the case of software, rectification in particular may take the course of providing a new program version, or WEISS indicating reasonable methods to circumvent the effects of the fault. The customer must accept the provision of a new program version including if associated with acceptable outlay for adaptation.

Rectification in the case of defects of title occurs by WEISS providing the customer with the means to use the software legally. WEISS in this regard may replace the software product for one of equal value and which complies with contractual provisions, if acceptable to the customer. Should third parties claim against the customer on the basis of property rights, the customer must notify WEISS of this in writing immediately. WEISS shall at its discretion and in consultation with the customer defend against or settle such claims. The customer must not acknowledge third party claims or settle these amicably. WEISS shall defend against third party claims at its own expense and shall indemnify the customer against all necessary costs and losses associated with defending against such action, provided such is not due to conduct on the part of the customer in breach of the terms and conditions. If attempts at rectification fail, the customer shall be allowed to reduce the fee payable or withdraw from the contract. Withdrawal, however, is permissible only if the customer previously and explicitly threatens WEISS with this in writing with a suitable further deadline.

6. Compensation for damages
Unless otherwise stated in the following regulations, WEISS shall be liable in accordance with statutory provisions in the case of the breach of contractual and non-contractual obligations. WEISS shall be liable for compensation for damages - irrespective of the legal basis - in the context of fault liability in cases of intent and gross negligence. Versionshinweise Weiss IoT Gateway 1.1.0

Diese Versionshinweise beschreiben den Inhalt und den Verwendungszweck des Weiss IoT Gateway, im Folgenden als Weiss IoT Gateway bezeichnet.

Dies ist die zweite stabile Version, die zur Produktion freigegeben wurde.

Systemanforderungen für die Installation des Weiss IoT Gateway Software:
Installiertes und lauffähiges Simpati 2016 oder neuer wird benötigt.

Erstellt für .NET Core 3.1 LTS. Das Framework ist auch im Installationspaket enthalten.

Einleitung

Die Software wird als Windows-Dienst geliefert, der eine  ASP.NET Core-Webanwendung startet.  Sie enthält eine browserbasierte Anwendung, die ein Dashboard und Werkzeuge für die Überwachung sowie Diagnose bereitstellt.

Die Browser-basierte App bietet eine Möglichkeit, sich bei Simpati Online anzumelden und die Anwendung zu registrieren. Nach der Registrierung übermittelt die Anwendung in regelmäßigen Abständen Daten an den Azure IoT Hub.

Datenübertragung
Die an die Cloud übertragenen Daten umfassen: Simpati-Metadaten, Kammer-Metadaten, Kammerprofile, Kammermodus und -zustand, Kammerfehler und andere Benachrichtigungen, Kammertelemetrie (Profilwerte und -grenzen).

Das Weiss IoT Gateway prüft jede Sekunde auf Fehler, Benachrichtigungen oder Modus- und Zustandsänderungen und veröffentlicht die Änderung, wenn sie entdeckt wird. Dies umfasst sowohl das Aufkommen als auch das Verschwinden von Fehlern. Die Software plant die Veröffentlichung von Telemetriedaten in einem Intervall, das aus der Einstellung „Archivierungsrate“ im Dialog „Kammerkonfiguration“ in Simpati übernommen wird.
Alle 5 Sekunden wird überprüft, ob sich diese Einstellung geändert hat.
Der Verbindungs- und Unterbrechungszustand und die Metadaten werden veröffentlicht, sobald eine Änderung ihres Wertes festgestellt wird.

Nachrichten-Warteschlange
Wenn die Verbindung zum IoT-Hub unterbrochen wird, werden die Nachrichten im Speicher in eine Warteschlange gestellt. Wenn die Verbindung wiederhergestellt ist und als stabil erachtet wird, werden die Nachrichten in der Warteschlange zuerst übermittelt, bevor es zur Verarbeitung neuer Nachrichten kommt. Die Warteschlange wird periodisch auf der Festplatte gespeichert, damit keine Nachrichten verloren gehen. Abhängig von der Größe der Warteschlange wird diese in Segmente unterteilt, die bei Bedarf zwischen Speicher und Festplatte getauscht werden. Die Warteschlange wird mit einer Prüfsumme gegen Manipulation signiert.
Das Weiss IoT Gateway veröffentlicht keine kammerbezogenen Daten, solange die Kammer offline ist. Dies gilt für alle Kammern während Simpati offline ist.

Geräteidentifizierung
Die Kammern werden durch ihre interne Seriennummer identifiziert. Wenn eine Kammer oder ein Controller keine Seriennummer oder eine ungültige Seriennummer übermittelt, dann generiert und verwendet das Weiss IoT Gateway eine Fallback-Seriennummer.
Das Weiss IoT Gateway wird durch eine Simpati-Seriennummer sowie eine eindeutige ID identifiziert. Die eindeutige ID wird pro installierter Instanz des Weiss IoT Gateways generiert.

Umgang mit Fehlern, die sich auf die Anwendung selbst beziehen (z. B. Kommunikation, Registrierung usw.), werden auf dem Dashboard in der Webanwendung angezeigt und nach deren Behebung aus dem Dashboard entfernt.

Die Software unterstützt verschiedene Ebenen und Kategorien der Protokollierung. Die Protokollierung kann so konfiguriert werden, dass ausgewählte Belange in einer ausgewählten Ausführlichkeitsstufe protokolliert werden. Es wird jeden Tag eine Protokolldatei erstellt. Die Protokolldateien werden nach einer konfigurierten Anzahl von Tagen entfernt (Standardeinstellung: 14 Tage).

Zustandsüberwachung
Die Stabilität bzw. der Zustand der Anwendung in Bezug auf bestimmte Faktoren wie

  • Speicherverbrauch,
  • freier Platz auf Festplatte,
  • Datenverkehr,
  • Größe der Nachrichten-Warteschlange,
  • Betrieb der Dienste,

wird ständig überwacht und in der Webanwendung angezeigt.

Das Weiss IoT Gateway enthält eine Fehlerreporter-Funktion, in der eine ZIP-Datei mit aktuellen Protokollen und Informationen über den Status der Kammer und den Zustand der Applikation heruntergeladen werden kann.

Cloud-Protokollierung
Der Bediener kann ebenfalls eine ZIP-Datei herunterladen, die einen Satz an CSV-Dateien mit jeder einzelnen Nachricht enthält, die vom IoT Gateway an Simpati Online in der Cloud übermittelt wurde. Die CSV-Dateien werden stets auf die lokale Festplatte geschrieben, sobald eine Nachricht erfolgreich zugestellt wurde. Die Aufbewahrungszeit dieser Dateien kann im Bereich „Konfiguration“ auf einen beliebigen Wert zwischen 1 und 30 Tagen eingestellt werden. Das Schreiben dieser Dateien kann auch vollständig deaktiviert werden. Es wird eine Datei pro Tag erstellt, wobei jede dieser Dateien mit einer Prüfsumme geschützt ist.

Betriebsunterbrechung
Der Betrieb des Weiss IoT Gateway kann im Bereich „Konfiguration“ unterbrochen werden. Im unterbrochenen bzw. gestoppten Zustand arbeitet der Windows-Dienst weiter (sodass die Webanwendung weiterhin „am Leben“ bleibt), aber es werden keine Daten von Geräten gesammelt und auch keine Daten an die Cloud übermittelt. Der Betrieb des Weiss IoT Gateway kann zu jedem Zeitpunkt wieder aufgenommen werden.

Wiederherstellung eines Gateways
Wenn eine Instanz des Weiss IoT Gateway auf einen anderen Computer verschoben oder nach einem Absturz des Betriebssystems oder dem Ausfall einer Festplatte neu installiert werden muss, kann die Identität der vorherigen Installation wiederhergestellt werden. Zu diesem Zweck muss der Bediener eine „Installations-ID“ wählen, welche die Installation des IoT Gateways identifiziert. Die „Installations-ID“ wird in der Cloud gespeichert. Nach der Wiederherstellung werden die Zugangsdaten zur Cloud-Plattform auf dem lokalen Computer verschlüsselt gespeichert. Sie können nicht auf einen anderen Computer kopiert werden, ohne dass der Tenant-Admin die Gateway-Installation erneut genehmigen muss.

Sonstiges

  • Es werden verschiedene Bereitstellungsphasen (Entwicklung, Vorschau, Integration und Produktion) unterstützt.
  • Der Name der Bereitstellungsphase und des Tenants wird im Bereich „Gerätestatus“ angezeigt.Es wird die Konfiguration von SimServ-Verbindungseinstellungen und Proxy-Einstellungen unterstützt.
  • Alle Kammersymbole von Simpati 4.80 werden unterstützt.
  • Der Simpati Kammerindex wird jetzt auch in die Cloud übertragen.

Liste der in dieser Version behobenen Bugs/Fehler

  • Hilfreiche Meldung, wenn die Gateway-Registrierung fehlschlägt: Wenn während der Gateway-Registrierung eine Ausnahmefehler auftritt (ein typischer Grund wäre beispielsweise, wenn der Zugriff auf die URL der Weiss API durch eine Firewall blockiert wird), wird eine hilfreiche Fehlermeldung angezeigt. Ein Link zur Ziel-URL wird angezeigt, sodass der Bediener prüfen kann, ob die URL für ihn zugänglich ist. Ist die URL nicht zugänglich, liegt ein Problem im Netzwerk des Kunden vor.
  • Verhindern der Registrierung von Geräten ohne Metadaten: Wenn ein Gerät zum Zeitpunkt der Registrierung bei Simpati Online nicht mit Simpati verbunden war, wurden seine Metadaten nicht übermittelt. Infolgedessen erschien das Gerät ohne Namen und zugehörige Profile in Simpati Online. Um dieses Problem zu beheben, werden Geräte nun erst dann in Simpati Online registriert, wenn sie tatsächlich mit Simpati verbunden sind. Einmal registriert, bleiben sie auch dann registriert, wenn die Verbindung vorübergehend unterbrochen wird.
  • Anzeigen des Hinweises „Starten“ beim Anwendungsstart: Beim Start der Anwendung zeigt das Home-Dashboard den Hinweis „Starten“ anstelle von „OK“ an, solange der Startvorgang läuft.
  • Fehlerbehebung für leere Nachrichten nach Verbindungsverlust: Ein Fehler wurde behoben, wo die Nutzlast einer Nachricht nach einer wiedergewonnenen Verbindung verloren gehen konnte.
  • Schnellere Wiederherstellung nach Verbindungsverlust: Die Verbindung wird nun wieder als stabil erkannt, wenn 10 Nachrichten erfolgreich gesendet wurden oder nach einer erfolgreichen Nachricht 2 Minuten (anstelle von ehemals 10 Minuten) vergangen sind.
  • Prüfung auf redundante Token-Antworten: Wenn ein Service am Backend mehrfach nacheinander dieselbe Token-Antwort zurückgibt, wird lediglich die erste Antwort verarbeitet.
  • Kammerfehler ignorieren, solange das Gerät nicht registriert ist: Wenn ein neues Gerät entdeckt wird, wird nicht auf Kammerfehler geprüft, solange das Gerät nicht in der Cloud registriert ist.
  • Keine Daten an Cloud übermitteln, bevor Simpati vollständig initialisiert ist: Wartezeit von 20 Sekunden, nachdem Simserv die Verbindung wiederhergestellt hat, da Simpati möglicherweise Zeit benötigt, um die Verbindung zu seinen Geräten herzustellen und die Initialisierung abzuschließen.
  • Fehlerhafte Erkennung von Profiländerungen: Unnötige Meldungen zu Profiländerungen wurden immer dann gesendet, wenn eine Warn- oder Alarmgrenze geändert wurde (dies betraf alle Programme mit einem Toleranzband).
  • Verbindungsverlust nach Ausnahmefehler „ObjectDisposedException“: Aufgrund eines Synchronisationsproblems konnte es vorkommen, dass ein Ausnahmefehler „ObjectDisposedException“ ausgegeben wurde, der die Übertragung von Nachrichten für ein Gerät stoppte.
  • Sicherheitsverbesserungen im Login-Prozess: Es wird nun geprüft, dass der angemeldete Bediener tatsächlich die Rolle „Tenantadmin“ innehat. Ebenfalls kann der Bediener nicht mehr über die „Zurück“-Schaltfläche seines Browsers den Anmeldungszustand wiederherstellen.

Weiss Umwelttechnik S!MPATI online

  • (1) S!MPATI liest Daten über SimServ auf dem localhost und leitet diese zum Gateway
  • (2) Das Gateway sendet die Daten mit dem Microsoft IoT SDK zum IoT Hub. Das Protokoll ist verschlüsseltes AMQP.
  • (3) Die Daten werden über einen Token identifiziert. Ein Gerät kann sich nur mit einem gültigen Token am IoT Hub anmelden. Tokens werden verschlüsselt auf dem S!MPATI System des Kunden gespeichert. Das Weiss IoT Gateway ist mit einem einmaligen und eindeutigen Token am Azure ActiveDirectory B2C angemeldet.

Verbindung und Datenspeicherung

Verbindung Kunde - Internet

  • Da die gesamte Kommunikation verschlüsselt ist, muss keine weitere Maßnahme (z.B. VPN) zur Verbindung zwischen dem Weiss IoT Gateway und den Microsoft Azure Services vorgesehen werden.
  • Die Ports 5671 and 443 müssen ausgangsseitig in der Kunden IT Infrastruktur geöffnet werden.

Vertrauenswürdige Zertifikatsstelle

  • Weiss Umwelttechnik GmbH vertraut auf die Kooperation mit dem Partner Microsoft.
  • Alle Services inklusive dem IoT Hub benutzen die Zertifikatsstelle, die von Microsoft Azure zur Verfügung gestellt wird.

Datenspeicherung

  • Alle Daten werden in Europa, Amsterdam, gespeichert.
  • Der Datenzugriff erfolgt über Token.
  • Mandanten sind strikt voneinander auf Zugriffsebene getrennt (Multi-Client Fähigkeit).

Verschlüsselung

Die gesamte Kommunikation ist verschlüsselt (API, Datenzugriffe, IoT Kommunikation)

Der Verschlüsselungsstandard entspricht dem Stand der Technik. Weiss Umwelttechnik GmbH nutzt die Cipher Suites mit

Authentifizierung und Benutzerverwaltung basieren auf der Microsoft Azure B2C Lösung.

Schlüssel und Rollenverifizierung sowie Benutzerautorisierung werden auf verteilten Systemen verwaltet.

Zusätzliche Sicherheitstests werden mit externen Spezialisten nach dem Stand der Technik durchgeführt.

Lizenzbedingungen

1. Geltungsbereich
Die oben genannten Gesellschaften (im Folgenden „WEISS“ genannt) liefern in elektronischer Form Computerprogramme wie Simpati sowie SPS Steuerungs- und Visualisierungsprogramme (im Folgenden Software) an Kunden (Lizenznehmer). 

Für die Einräumung von Nutzungsrechten an Software von WEISS gelten ausschließlich die nachstehenden Bedingungen. Anderslautende allgemeine Geschäftsbedingungen des Kunden finden keine Anwendung, es sei denn WEISS hätte diesen ausdrücklich (mindestens in Textform) zugestimmt.

2. Lieferungen und Leistungen von WEISS
Der Lieferumfang ergibt sich im Einzelnen aus der jeweils aktuellen Produktbeschreibung einschließlich ergänzender Angaben in der Anwendungsdokumentation. WEISS liefert die Software in der zum Lieferoder Bereitstellungszeitpunkt aktuellen Fassung. Installations-, Einweisungs- und Schulungsleistungen sind nicht im Lieferumfang enthalten. Die Lieferung der Software erfolgt nach Wahl von WEISS per Datenträger oder im Wege des Online-Abrufes (Download) über eine Website von WEISS. Der Kunde erhält ausschließlich Rechte am Objektcode der Software. Er hat keinen Anspruch auf Nutzung oder Übergabe des Quellcodes..

Leistungen bezüglich des Supportes und der Pflege der Software erbringt WEISS nur aufgrund gesonderter schriftlicher Vereinbarung.

3. Einräumung von Nutzungsrechten
WEISS räumt dem Kunden - vorbehaltlich einer abweichenden individualvertraglichen, schriftlichen Vereinbarung - aufschiebend bedingt auf den Zeitpunkt der vollständigen Zahlung der vereinbarten Vergütung, das nicht ausschließliche, dauerhafte, unwiderrufliche und unkündbare Recht ein, die Software zu nutzen, das heißt insbesondere dauerhaft oder temporär zu speichern und zu laden, sie anzuzeigen und ablaufen zu lassen.

Ohne ausdrückliche Vereinbarung wird das Nutzungsrecht ausschließlich für das Land eingeräumt, in dem der Kunde seinen Geschäftssitz hat. Ist der Geschäftssitz innerhalb der Europäischen Union, gilt das Nutzungsrecht EU-weit. Der Kunde darf die Software nur zu dem vertraglich vorgesehenen Zweck nutzen. Die gewerbliche Weitervermietung ist untersagt. Vervielfältigungen der Software sind nur insoweit zulässig, als dies für den vertragsgemäßen Gebrauch notwendig ist. Der Kunde darf von der Software Sicherungskopien nach den Regeln der Technik im notwendigen Umfang anfertigen. Sicherungskopien auf beweglichen Datenträgern sind als solche zu kennzeichnen und mit dem Urheberrechtsvermerk des Originaldatenträgers zu versehen.

Überträgt der Kunde sein Nutzungsrecht an einen Dritten, hat er seine Verpflichtungen aus diesen Bedingungen hinsichtlich Inhaltes und Umfang der Nutzungsrechte dem Dritten aufzuerlegen. Mit der Übertragung an den Dritten ist der Kunde nicht mehr zur Nutzung berechtigt. Er hat etwaige Kopien der Software zu löschen, soweit es sich nicht um Kopien zur ordnungsgemäßen Datensicherung handelt.

Der Kunde verpflichtet sich, die Software nicht in eine andere Codeform zu bringen und keine Änderungen, Erweiterungen oder sonstige Bearbeitungen der Software vorzunehmen, es sei denn, dass dies nach den gesetzlichen Vorschriften zulässig ist.

Überlässt WEISS dem Kunden im Rahmen von Nachbesserung oder Pflege Ergänzungen (z. B. Patches, Ergänzungen des Bedienerhandbuches) oder eine Neuauflage der Software (z. B. Update, Upgrade), die früher überlassene Software („Altsoftware“) ersetzt, unterliegen sie diesen Bestimmungen. Stellt WEISS eine Neuauflage der Software zur Verfügung, so erlöschen in Bezug auf die Altsoftware die Befugnisse des Kunden auch ohne ausdrückliches Rückgabeverlangen von WEISS, sobald der Kunde die neue Software produktiv nutzt. WEISS räumt dem Kunden jedoch eine dreimonatige Übergangsphase ein, in der beide Versionen nebeneinander genutzt werden dürfen. Eine Vervielfältigung oder Umarbeitung der Anwendungsdokumentation ist – vorbehaltlich des Vorgenannten – nicht gestattet.

Bei durch WEISS vertriebenen Softwareprodukten von Drittherstellern bzw. implementierten Drittsoftwareelementen gelten die Nutzungsbedingungen der Dritthersteller für diese Software(teile) vorrangig.

4. Mitwirkungspflichten des Kunden
Der Kunde trifft angemessene Vorkehrungen für den Fall, dass von WEISS gelieferte Software ganz oder teilweise nicht ordnungsgemäß arbeitet. Er wird die Software gründlich auf Mangelfreiheit, deren Verwendbarkeit zu dem von ihm beabsichtigten Zweck und in der von ihm zur Verfügung gestellten

Hard- und Softwareumgebung testen, bevor er diese operativ einsetzt. Dies gilt auch für Software, die er von WEISS im Rahmen der Gewährleistung oder Pflege erhält. Das Vorhandensein oder die Einrichtung einer funktionsfähigen, ausreichend dimensionierten Hard- und Softwareumgebung liegt in der alleinigen Verantwortung des Kunden.

Weiterhin wird er seine Daten nach dem Stand der Technik sichern. Er stellt sicher, dass die aktuellen Daten aus in maschinenlesbarer Form bereitgehaltenen Datenbeständen mit vertretbarem Aufwand reproduzierbar sind. Der Kunde unterhält ein dem Stand der Technik entsprechendes IT-Sicherheitskonzept bestehend aus technischen und organisatorischen Maßnahmen. Im Rahmen dessen trifft er insbesondere angemessene Maßnahmen, um die Software vor dem unbefugten Zugriff durch Dritte zu schützen.

Festgestellte Mängel hat der Kunde unverzüglich an WEISS zu melden. Die Mängelrüge muss Informationen über die Art des Fehlers, bei Software das Modul, in dem der Fehler aufgetreten ist, sowie die Arbeiten, die bei Auftreten des Fehlers durchgeführt wurden, enthalten. Voraussetzung für die Nacherfüllung gemäß Ziffer 5 ist die Reproduzierbarkeit oder Feststellbarkeit eines gemeldeten Mangels.

5. Sach- und Rechtsmängel
WEISS verschafft dem Kunden Lieferungen und Leistungen frei von Sach- und Rechtsmängeln. Dem Kunden ist bewusst, dass kleinere Programmfehler, die die Nutzbarkeit der Software nicht oder nur unerheblich einschränken, bei Softwareprodukten nicht vollständig ausgeschlossen werden können. Solche unerheblichen Fehler stellen keinen Mangel der Software im Sinne der Gewährleistung dar. Bei Software sind ferner solche Funktionsbeeinträchtigungen keine Mängel, die aus der vom Kunden zur Verfügung gestellten Hardware- und Softwareumgebung, Fehlbedienung, externen schadhaften Daten, Störungen von Rechnernetzen oder sonstigen aus dem Risikobereich des Kunden stammenden Gründen resultieren.

Für Software, die vom Kunden widerrechtlich geändert worden ist, hat WEISS nicht einzustehen, es sei denn, der Kunde weist nach, dass die Änderung für den gemeldeten Mangel nicht ursächlich ist. Soweit Lieferungen und Leistungen von WEISS mangelhaft sind und dies vom Kunden rechtzeitig schriftlich beanstandet wurde, wird WEISS nach seiner Wahl nachliefern oder nachbessern (Nacherfüllung). Hierzu ist WEISS Gelegenheit innerhalb angemessener Frist von mindestens vierzehn Werktagen zu gewähren. Bei Software kann die Nacherfüllung insbesondere durch Überlassung einer neuen Programmversion oder dadurch erfolgen, dass WEISS zumutbare Möglichkeiten aufzeigt,

die Auswirkungen des Mangels zu umgehen. Eine neue Programmversion muss vom Kunden auch dann übernommen werden, wenn dies für ihn zu einem hinnehmbaren Anpassungsaufwand führt.

Die Nacherfüllung bei Rechtsmängeln erfolgt, indem WEISS dem Kunden eine rechtlich einwandfreie Nutzungsmöglichkeit an der Software verschafft. WEISS kann hierbei die betroffene Software gegen eine gleichwertige, den vertraglichen Bestimmungen entsprechende Software austauschen, wenn dies für den Kunden hinnehmbar ist. Falls Dritte Schutzrechte gegen den Kunden geltend machen, unterrichtet dieser WEISS unverzüglich schriftlich. WEISS wird nach seiner Wahl und in Absprache mit dem Kunden die Ansprüche abwehren oder befriedigen. Der Kunde darf von sich aus die Ansprüche Dritter nicht anerkennen oder die Inanspruchnahme gütlich beilegen. WEISS wehrt die Ansprüche Dritter auf eigene Kosten ab und stellt den Kunden von allen mit der Anspruchsabwehr verbundenen notwendigen Kosten und Schäden frei, soweit diese nicht auf einem pflichtwidrigen Verhalten des Kunden beruhen. Schlägt die Nacherfüllung fehl, kann der Kunde die Vergütung mindern oder vom Vertrag zurücktreten. Der Rücktritt ist allerdings nur zulässig, wenn der Kunde WEISS dies zuvor ausdrücklich schriftlich mit einer angemessenen weiteren Nachfrist androht.

6. Schadensersatz
Soweit sich aus den nachfolgenden Regelungen nichts Abweichendes ergibt, haftet WEISS bei einer Verletzung von vertraglichen und außervertraglichen Pflichten nach den gesetzlichen Vorschriften.

WEISS haftet auf Schadensersatz – gleich aus welchem Rechtsgrund – im Rahmen der Verschuldenshaftung bei Vorsatz und grober Fahrlässigkeit. Bei einfacher Fahrlässigkeit haftet WEISS vorbehaltlich eines milderen Haftungsmaßstabs nach den gesetzlichen Vorschriften (z.B. für Sorgfalt in eigenen Angelegenheiten) nur

a) für Schäden aus der Verletzung des Lebens, des Körpers oder der Gesundheit,

b) für Schäden aus der nicht unerheblichen Verletzung einer wesentlichen Vertragspflicht (Verpflichtung, deren Erfüllung die ordnungsgemäße Durchführung des Vertrags überhaupt erst ermöglicht und auf deren Einhaltung der Vertragspartner regelmäßig vertraut und vertrauen darf); in diesem Fall ist die Haftung jedoch auf den Ersatz des vorhersehbaren, typischerweise eintretenden Schadens begrenzt.

Die vorgenannten Haftungsbeschränkungen gelten auch bei Pflichtverletzungen durch bzw. zugunsten von Personen, deren Verschulden WEISS nach gesetzlichen Vorschriften zu vertreten hat. Sie gelten nicht, soweit WEISS einen Mangel arglistig verschwiegen oder eine Beschaffenheitsgarantie übernommen hat und für Ansprüche des Kunden nach dem Produkthaftungsgesetz. Aussagen zur

Beschaffenheit der Software sind als Leistungsbeschreibung zu verstehen und stellen keine Beschaffenheits- oder Haltbarkeitsgarantie im Sinne von § 443 BGB dar.

Bei Datenverlusten haftet WEISS nur für den Schaden, der auch bei ordnungsgemäßer Datensicherung durch den Kunden (Ziffer 4) entstanden wäre.

7. Haftung des Kunden und außerordentliche Kündigung
Der Kunde haftet gegenüber WEISS für alle Schäden, die WEISS aus der Verletzung der urheberrechtlichen Bestimmungen aus Ziffer 3 entstehen.

WEISS ist berechtigt, die dem Kunden eingeräumten Nutzungsrechte zu widerrufen, wenn der Kunde trotz Mahnung seitens WEISS wiederholt die nach Ziffer 3 eingeräumten Nutzungsrechte überschreitet oder keine dem Stand der Technik entsprechenden Vorkehrungen zur IT-Sicherheit im Sinne der Ziffer 4 trifft. In diesem Falle ist der Kunde verpflichtet, die Nutzung der Original-Software nebst sämtlichen Kopien unverzüglich einzustellen und diese zu vernichten. Der Kunde hat eine schriftliche Bestätigung der Vernichtung an die unten angegebene Adresse zu übersenden.

8. Rechtswahl und Gerichtsstand
Für alle Rechtsbeziehungen zwischen WEISS und dem Kunden, denen diese Bedingungen zu Grunde gelegt werden, gilt das Recht der Bundesrepublik Deutschland unter Ausschluss des Übereinkommens der Vereinten Nationen über Verträge über den internationalen Warenkauf (CISG).

Die Parteien sind sich darüber bewusst, dass die Software Export- und Importbeschränkungen unterliegen kann. Insbesondere können Genehmigungspflichten bestehen bzw. kann die Nutzung der Software oder damit verbundener Technologien im Ausland Beschränkungen unterliegen.

Der Kunde wird die anwendbaren Export- und Importkontrollvorschriften der Bundesrepublik Deutschland, der Europäischen Union und der Vereinigten Staaten von Amerika, sowie alle anderen einschlägigen Vorschriften einhalten. Die Vertragserfüllung des Lizenzgebers steht unter dem Vorbehalt, dass der Erfüllung keine Hindernisse aufgrund von nationalen und internationalen Vorschriften des Export- und Importrechts sowie keine sonstigen gesetzlichen Vorschriften entgegenstehen.

Sofern der Kunde Kaufmann, öffentlich-rechtliches Sondervermögen oder eine juristische Person des öffentlichen Rechts ist, ist ausschließlicher Gerichtsstand für alle sich aus den vorgenannten Rechtsbeziehungen ergebenden Ansprüche der Sitz von WEISS; erhebt WEISS Klage, so gilt daneben auch der allgemeine Gerichtsstand des Kunden.
